This document, called “Terms of Use”, establishes a legal agreement between you (“USER”) and DadosCorp (“PLATFORM”). By registering, accessing, or using any of the services offered, you declare that you have read, understood, and fully accepted all the conditions described herein. If you are using the services on behalf of an organization, you declare that you have the authority to bind it to this agreement. Use of the PLATFORM is conditional upon full and unrestricted acceptance of all clauses herein, including the Acceptable Use Policy. If you disagree with any provision, you are not authorized to use the services and must immediately discontinue access. The PLATFORM reserves the right to modify these Terms at any time, and it is the USER's responsibility to review them periodically. Continued use after a change implies tacit acceptance of the new conditions.
DadosCorp is an Internet of Things (IoT) platform that allows the USER to manage projects, connect devices such as microcontrollers (e.g., ESP32, Arduino), collect and visualize telemetry data, and remotely trigger actuators. The PLATFORM offers, non-exhaustively, the following services: Project and Device Management, Data Ingestion, Remote Control, PWA Generation, Sharing and Community.
Project and Device Management: Registration and organization of multiple devices within projects.
Data Ingestion: Collection of data sent by devices through different communication protocols.
Remote Control: Functionality for sending commands that can change the state of a device (e.g., turning an LED or relay on/off).
PWA Generation: Automated creation of an installable Progressive Web App that replicates control functions for a specific device.
Sharing and Community: Tools to create public dashboards and interact in a community forum.
The PLATFORM offers different usage tiers, including a free plan (“Maker Plan”). The Maker Plan grants the USER the right to register up to 5 (five) devices with a data sending rate limit of 1 (one) request every 10 (ten) seconds per device, and is designed for educational purposes, prototyping, and small-scale non-commercial personal projects. The PLATFORM is committed to maintaining the essence of this plan as a free and generous entry point for the maker community, in line with its mission. Paid plans with greater capabilities and limits will be available for commercial use or larger-scale projects. The PLATFORM reserves the right to modify plan features with prior notice.
To use the PLATFORM, you declare that you are over 18 (eighteen) years of age or have full civil capacity, or are using it under the supervision of a legal guardian. By creating an account, you agree to provide true, accurate, and complete information and to keep it updated. You are fully responsible for maintaining the confidentiality of your access credentials (email and password) and for all activities that occur under your account. The PLATFORM is not responsible for unauthorized access resulting from the USER's negligence in safeguarding their credentials. You agree to notify us immediately of any unauthorized use of your account or any other security breach.
The USER agrees not to use, facilitate, or allow third parties to use the PLATFORM for any purposes other than those expressly permitted by these Terms. Violation of this policy will result in immediate account suspension and the adoption of appropriate legal measures. The following uses are expressly prohibited:
a) Illegal Activities and Terrorism: Any activity that violates local, national, or international laws and regulations. The use of the platform for acts of terrorism, sabotage of essential services, or any activity involving explosives is strictly prohibited.
b) High-Risk Applications and Personal Safety: It is strictly prohibited to use the PLATFORM in “Unauthorized Applications”, defined as systems or devices whose failure or misuse may result in death, physical harm, or significant environmental damage, including life support systems, nuclear facilities, aircraft navigation, weapons systems, and detonators. Exception via Special Agreement with proper government authorizations required.
c) Rights Violation: Violating the intellectual property rights of third parties.
d) Malicious and Abusive Conduct: Engaging in harassment, abuse, defamation, or distributing obscene content or hate speech.
e) Platform Security and Fraud: Attempting to gain unauthorized access, distributing malware, or using the services for fraudulent activity.
The USER is solely responsible for the devices connected to the PLATFORM and ensuring their use complies with the law and these Terms, the content transmitted, and maintaining adequate security measures. You retain all rights to the data you generate and transmit through the PLATFORM (“Your Data”). By using the PLATFORM, you grant DadosCorp a limited license to process, store, and display this data for the sole purpose of providing, maintaining, and improving the contracted services.
The processing of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. The PLATFORM acts as a data processor for the personal data you, as the data controller, decide to collect and transmit through your devices.
The PLATFORM is provided “AS IS”, without warranties of any kind. To the maximum extent permitted by law, DadosCorp shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the PLATFORM.
We reserve the right to suspend or terminate your account without prior notice for: (a) violation of these Terms; (b) upon request by competent legal authorities; or (c) prolonged inactivity. In cases of Unauthorized Applications clause violation, suspension shall be summary and immediate.
DadosCorp values ethics and transparency. We are committed to cooperating with competent police and judicial authorities, providing necessary information upon court order. Any suspicion of a crime will be proactively reported.
The PLATFORM reserves the right to modify these Terms of Use at any time. We will notify users of significant changes through a prominent notice on the website or by email. Continued use constitutes acceptance of the new terms.
This agreement is governed by the laws of the Federative Republic of Brazil. The parties elect the Court of the District of Santa Maria, State of Rio Grande do Sul, expressly waiving any other, however privileged it may be.
